Terms of Service

Last updated: [[DATE]]. These terms are between you and [[BUSINESS LEGAL NAME]] of [[BUSINESS POSTAL ADDRESS]], trading as Byte2Bite (“we”, “us”).

1. What we do

We design, build and host a website for your restaurant. You pay a monthly subscription for as long as you want us to host it and keep it up to date. There is no minimum term and no contract to sign beyond these terms.

2. Your subscription renews automatically

Your plan renews by itself every month and your card is charged automatically until you cancel. Starter is $39 per month and Pro is $79 per month, plus tax where it applies. We will tell you before we change a price, and you can cancel instead of accepting it.

3. Cancelling

You can cancel any time, yourself, from the Billing page of your dashboard. It takes one click and you never have to phone us to do it.

  • Cancelling stops the next payment. Your website stays online until the end of the month you have already paid for — you keep what you paid for.
  • After that date your website address stops serving your site. Visitors see a short page with your phone number and a link to your Google listing, so your customers can still reach you.
  • You can still sign in to your dashboard. Your menu, prices and photos stay exactly where they are, and you can download all of it at any time.
  • Turning your website back on is one payment away. Nothing has to be rebuilt.

4. If a payment fails

Cards expire and banks decline things. If a payment fails, your website stays online while we retry it over roughly 21 days, and we will tell you in your dashboard and try to reach you. If it still has not gone through after that, the subscription ends and section 3 applies.

5. Who owns what

  • Your content is yours. Your menu, prices, hours, photos, your name and your words belong to you. You give us permission to publish them on your website while you are our customer, and nothing more.
  • Your domain name is yours. We register it in your name. If you leave, you take it with you and we will help you move it.
  • The design and the software are ours. You are licensed to use them while you subscribe. Ending your subscription ends that licence, unless you buy the site outright under section 6.
  • You confirm that you are entitled to give us the photos and text you send us, and that publishing them does not infringe anyone else’s rights.

6. Buying your website outright

For a one-off payment of $1,200 you can keep your website permanently. What you receive is: your finished site exported as files you can host anywhere, all of your content, and your domain transferred into your own account, together with a permanent licence to use that exported site.

Your monthly plan stops on the day you buy it out. We keep your site online for 30 days while your domain moves, and after that hosting, security updates and any further changes are yours to arrange. You are not buying our software, our other customers’ sites, or our source code.

7. How long we keep your content

If your website is switched off we keep everything for 12 months, so you can come back or take your content with you. After that we may delete it. We will try to warn you first.

8. What we will not publish

We may refuse or remove content that is unlawful, that we believe infringes someone else’s rights, or that is not related to your restaurant. If that happens we will tell you why and give you a chance to fix it.

9. What we promise, and what we do not

We work hard to keep your site online and correct, but we cannot promise it will never be unavailable, and we do not promise any particular number of visitors, any position in Google, or any increase in business. Hosting, domains and payments rely on other companies and we are not responsible for their failures.

Nothing in these terms limits liability for fraud, or for anything that cannot legally be limited. Otherwise, our total liability to you is limited to the amount you paid us in the three months before the problem arose.

10. Ending it from our side

We may end this agreement with 30 days’ notice, or immediately if you do not pay, if you use the service unlawfully, or if you ask us to publish something we will not publish. If we end it for our own convenience we will refund the unused part of the month.

11. Changes to these terms

If we change these terms in a way that matters, we will tell you at least 30 days before it takes effect, and you can cancel instead.

12. Law
